Proof of address in Spain: what an assignment really needs

Padrón registration, TIE appointments, healthcare, banking and school places in Spain all hinge on a documented address. Here is what proof of address actually unlocks on a Málaga assignment, and how a corporate temporary housing agreement supports each step.

The paperwork comes before the property

Most accommodation decisions for an assignment are made on location, size and budget. The item that causes the most avoidable friction in month one is narrower than that: proof of address. Spain runs a large part of its administrative life through the address a person is registered at, and an employee who cannot document theirs will stall on tasks that have nothing to do with housing. Getting proof of address for a Spain assignment right at contract stage — rather than after arrival — removes a fortnight of chasing from your assignee's first month.

This is not a legal guide, and requirements are set locally and change. Treat the list below as a briefing checklist to verify with the Ayuntamiento de Málaga, the relevant Extranjería office, and your own immigration adviser or gestor before the employee travels.

Proof of address in Spain: the assignment tasks that depend on it

An address is not a single document. It is the input to a chain of registrations, each of which tends to demand the one before it:

  • Padrón municipal. The certificado de empadronamiento is the town hall's record that a person lives at a given address in that municipality. It is the document most other processes ask for, and it normally requires a lease, or the landlord's written authorisation, plus identification.
  • TIE and residence formalities. Appointment booking and card issue routinely require an address in Spain, and in many cases the padrón certificate.
  • Healthcare registration. Assignment to a local health centre and issue of a health card are handled on a residential basis, so the padrón sits upstream of the appointment.
  • Banking. Spanish banks apply their own onboarding rules and commonly ask for an address, along with identification and proof of employment or income. Requirements differ between institutions.
  • Driving matters. Licence exchange and vehicle registration are handled by the DGT and are address-dependent; the rules vary by the licence's country of issue and should be checked directly.
  • School and nursery places for accompanying family, where allocation is typically tied to registered address.
  • Official notifications. Tax correspondence, appointment confirmations and delivery of the residence card itself all go to a physical address, so it needs to be stable and reachable.

One practical note that catches teams out. In many countries a utility bill in the employee's own name is the standard proof of address. In corporate housing, utilities are usually held and managed by the operator, so no such bill exists. That is a benefit operationally — nothing to connect, nothing to close on departure — but it means the lease and the padrón certificate become the documents your employee leans on. Brief them accordingly, and ask your provider up front what it can supply in writing.

Why the temporary housing framework matters

Spanish residential leasing sits under the Ley de Arrendamientos Urbanos (LAU). Following the reform enacted by Real Decreto-ley 29/2026, in force since 8 October 2026, the old seasonal framework (arrendamiento por temporada under Title III) no longer applies to housing accommodating people. Temporary accommodation for an assignment is now classified as arrendamiento de vivienda temporal under Title II, the housing rules.

Under this framework (art. 2.3 LAU), the contract covers a tenant's housing need while temporarily away from their habitual home for a justified and demonstrable reason. That cause must be stated expressly in the agreement and must be real and provable, with the landlord bearing the burden of proof. Because the decree-law must be validated by Congress within 30 days, mobility teams should verify the current statutory position when signing.

That legal footing is what a hotel confirmation or a listings-platform booking cannot reproduce. A booking gives you a receipt for nights stayed. A formal lease gives your employee a named, dated document tying a person to a property, which is the form administrative processes are built to read. If you want the detail on how leasing, invoicing and the legal framework work in practice, our answers to leasing and invoicing questions set out the position we work to.

When the company is the tenant and the employee is the occupant

Corporate housing is contracted company to company. That is what makes consolidated billing and a single point of contact possible, and it is also the point where proof of address needs a moment's thought: the tenant on the contract is the employer, not the individual who will be showing the document at a counter.

Under the revised LAU, how the definition of temporary housing applies where a company is the tenant and an employee is the occupant is not settled; a Spanish lawyer should confirm the position for your arrangement.

In operational terms, this coordination should be handled deliberately before signing. Confirm with the provider:

  • whether occupants can be named in the contract or in an annex to it;
  • whether the operator will confirm occupancy and dates in writing on request, addressed to the employee;
  • who at the operator answers such a request, and how quickly;
  • that the address on the paperwork is the residential address the employee will actually occupy;
  • that the contract term covers the assignment, so the address does not change mid-placement and force a second round of registrations.

That last point is the quiet cost of splitting an assignment across a hotel and then a flat. Every address change means repeating the padrón, updating records and re-notifying anyone who holds the old address.

How this works at Palacete 10

We contract with the company, not the individual: one supplier, one contract, and one monthly Spanish VAT (IVA) invoice covering everything, formatted for your finance team. Stays are structured under a direct corporate accommodation agreement in accordance with the applicable Spanish legal framework. Utilities are managed by us and active from day one, and access is by smart keyless entry, so arrival needs no physical handover. Lease terms are agreed per contract, and a Spanish bank account is not required.

The address itself is a residential one on Calle Actriz Rosario Pino, in a restored 1908 villa. Everyday shops, cafés, supermarkets, pharmacies and public transport are a minute's walk; the historic centre is fifteen minutes on foot; María Zambrano station is ten minutes and Málaga Airport sixteen. You can see the full picture of what corporate housing here includes and how the neighbourhood connects.
